RCFE CONNECT TERMS OF SERVICE

Welcome and thank you for your interest in RCFE Connect (“RCFE Connect,” “us,” “our,” or “we”). By clicking a registration or new account submission button, or by otherwise using our websites, networks, mobile applications, or other services provided by RCFE Connect (collectively, the “Services”), or accessing any content provided by us through the Services, you agree to be bound by the following terms of use, as updated from time to time (the “Terms of Use”).
1. RCFE Connect's Role and Disclaimers
- Purpose: RCFE Connect provides an administrative matching and digital marketing platform designed to connect Residential Care Facilities for the Elderly (RCFEs) seamlessly with home care agencies and families seeking immediate residential care placement.
- No Guarantee of Inquiries or Vacancy Fills: While our Services are engineered to maximize your facility's operational revenue potential, RCFE Connect does not represent, warrant, or guarantee that listing a property, maintaining an active profile, or purchasing a subscription tier will result in actual client inquiries, active leads, consumer phone calls, or filled bed vacancies.
- No Professional Advice: Unless explicitly specified by the terms of use for a particular service, the Services are intended strictly for informational, marketing, and matchmaking purposes. RCFE Connect does not provide you with financial, real estate, medical, placement, or legal advice of any kind. Listers and consumers must rely on their own independent judgment when evaluating care placements, operational changes, or contracts.
2. Eligibility, Accounts, and Registration
- Age Requirement: You must be at least 18 years of age to use the Services. By agreeing to these Terms of Use, you represent and warrant that: (a) you are at least 18 years of age; (b) you have not previously been suspended or removed from the Services; and (c) your registration and use of the Services complies with all applicable local, state, and federal laws and regulations.
- Account Integrity: To access specific features of the Services, you are required to register for an account. You agree that all registration information you provide to us (such as corporate name, facility license number, email address, phone number, or other contact details) is accurate and that you will keep it accurate and up-to-date at all times.
- Account Confidentiality: You are solely responsible for maintaining the strict confidentiality of your account credentials and password, and you accept full responsibility for all actions and transactions taken via your account. You may not share your user account(s) or login credentials with unauthorized third parties.
3. Membership Tiers, Fees, and Non-Refundability
RCFE Connect offers premium subscription tiers and specialized standalone add-ons to optimize lead volume and fast-track vacancy fulfillment. By activating a subscription service or ordering an add-on, you authorize our third-party payment processors to charge the specified payment method on a recurring or per-transaction basis.
A. Subscription Membership Tiers
- Essential ($49.99 / mo): Best for small or newly established care homes seeking baseline local visibility. Includes a Standard Directory Listing (facility details, contact info, photos), Direct Client Inquiries via automated lead notifications from searching families, and a Welcome Marketing Kit (offline professional physical brochure templates and customized calling cards).
- Professional ($89.99 / mo): Designed for established homes looking to optimize lead volume and fill vacancies fast. Includes all Essential features, plus the Live Bed Tracker (real-time vacancy indicator badge on listing), a Weekly Analytics Report (tracking listing views, click-throughs, and captured visitor email addresses), Priority Search Placement consistently positioned above Tier 1 listings, and a “Verified Facility” Badge to build trust.
- Premium Growth ($149.99 / mo): For premium facilities wanting full compliance protection and maximum market share. Includes all Essential and Professional features, plus an Annual Mock Licensing Check (comprehensive yearly inspection mockup to eliminate state citation risks), Featured Showcase rotating homepage and regional banner placement, and Instant Lead Routing via direct real-time SMS/Email alerts the second a client matches your profile.
B. A La Carte Revenue Maximizers & High-Margin Add-Ons
- Standalone Mock Inspections ($499 - $799 / inspection): Full compliance assessment and comprehensive reporting for non-subscribers looking to secure their state licenses risk-free.
- Premium Lead Pay-Per-Match ($25 - $50 / vetted lead): Gain immediate access to highly motivated, exclusive, premium leads pre-screened to precisely fit your care level and pricing structure.
- Spotlight Boost Weeks ($29.99 / week): Instantly pin your care home to the top row of all localized regional directories for 7 days to accelerate vacancy fills.
C. Payment Terms and Cancellation
- Strictly Non-Refundable: All fees are billed in U.S. dollars. All purchases, recurring monthly subscription fees, and individual a la carte add-on charges are strictly non-refundable under any circumstances.
- Automatic Billing: Subscription services allow for automatically recurring payments for periodic charges. You authorize us to periodically charge all accrued sums on or before the payment due date until cancellation.
- Cancellation Policy: You must cancel your subscription service before it automatically renews in order to avoid billing of the next periodic subscription fee to your account. Unless otherwise stated, you may cancel a subscription through your account settings page or by contacting Customer Support at care@rcfeconnect.com.
4. Data Sourcing, Automated Analysis, and Marketing Sublicense
- Public Record Sourcing: RCFE Connect aggregates, cleans, and utilizes directory information gathered primarily from public records, including but not limited to data from the California Department of Social Services (CDSS) Community Care Licensing Division. Listers acknowledge that RCFE Connect is an independent platform and has no official branch affiliation with or endorsement from the CDSS.
- System Data Analysis: Our system continuously performs complex data analysis, user tracking, and traffic aggregation. All facility listers acknowledge and agree that RCFE Connect may analyze listing data, visitor behavior, and contact patterns, and that resulting statistical metrics will be generated and shared with facility listers (subject to tier restrictions) to assist in local operational optimization.
- Marketing Authorization and Consent (CCPA/CPRA Compliant): All listers acknowledge and expressly agree that their corporate names, listed contact information, facility addresses, capacity data, and other public or submitted information may be utilized by RCFE Connect for promotional and marketing purposes. The explicit purpose of this data utilization is to maximize digital exposure, assist listers in marketing their facilities, enhance regional directory placement, and actively help listers fill their open beds.
5. User Generated Content (UGC) Disclaimer
- No Obligation to Control: RCFE Connect is under no obligation to edit, monitor, or control the photos, text, bed descriptions, or other materials uploaded by users (“User Materials”), and we expressly disclaim any and all liability in connection with User Materials.
- Content Moderation: We reserve the right, in our sole discretion and without prior notice, to screen, remove, edit, or block any user content or facility listings at any time if we find them to be misleading, inaccurate, offensive, objectionable, or in violation of these Terms of Use.
- Waiver of Claims: You understand that when using the platform, you may be exposed to listings and vacancy statuses from other facilities that may be outdated or inaccurate. You agree to waive, and hereby do waive, any legal or equitable right or remedy you have against RCFE Connect with respect to user-provided content.
6. Third-Party Tools, Lead Routing, and External Links
- Lead Routing and Distribution: The Services include automated functionality that routes your facility details or contact requests directly to Third-Party Providers, searching families, or placement agencies not under our control. You are solely responsible for your direct dealings, placement agreements, or business relationships with any third party arising in connection with the Services.
- Stripe Integration: Subscription billing and payment processing services are facilitated via Stripe Connect tools. Your use of these features is subject to the Stripe Connected Account Agreement, and you agree not to utilize Stripe or the platform for any prohibited or illegal business purposes.
- Localization and Mapping: The platform implements Google Maps web mapping services. Your use of mapping directory tools constitutes full compliance and agreement with Google's Terms of Service and Privacy Policy.
- Background Screening: To the extent that our facility tools integrate third-party background check tools (such as CIC), users authorize the processing of reports in strict compliance with federal and state regulations. Listers acknowledge that reporting of court records is restricted by local laws, and our screening partner does not use Artificial Intelligence (AI) in the collection or hygiene of these criminal records.
- Compliance and Fair Housing: We do not guarantee client acceptance or regulatory approval. However, RCFE Connect requires all participating facilities and landlords using our platform to operate in strict compliance with the federal Fair Housing Act, the California Unruh Civil Rights Act, CDSS guidelines, and all state anti-discrimination and elder protection statutes.
7. Mock Licensing Inspections Disclaimer (California Title 22 Compliance)
For premium listers utilizing the Annual Mock Licensing Check or purchasing a Standalone Mock Inspection, you understand and acknowledge that these assessments are patterned explicitly after California Code of Regulations (CCR) Title 22, Division 6 standards governing Residential Care Facilities for the Elderly. These reviews are strictly educational simulation tools designed to help operators proactively identify potential operational risks. RCFE Connect does not represent, warrant, or guarantee that a facility will be completely free of state citations, administrative fines, or enforcement penalties during an official inspection conducted by the California Department of Social Services (CDSS) or any other government authority. Maintaining absolute regulatory compliance remains the sole, un-delegable legal responsibility of the licensed facility operator.
8. Limitation of Liability and Indemnification
- As-Is Basis: RCFE Connect provides its platform, directory database, trackers, and mock assessment forms on an “As-Is,” “With All Faults,” and “As Available” basis. Listers assume the entire risk as to satisfactory performance, accuracy, and results.
- Liability Limit: To the maximum extent permitted by applicable law, the aggregate liability of RCFE Connect and its affiliates for all claims arising out of or relating to the use or inability to use the Services shall be limited to the greater of: (1) the total amount you have paid to RCFE Connect for the specific service in the 12 months prior to the event giving rise to the claim, or (2) $100.
- Indemnification: You agree to indemnify, defend, and hold harmless RCFE Connect, its parent entities, directors, and employees from any and all third-party claims, liabilities, losses, or demands arising out of: (a) your access to or use of the platform; (b) your breach of these Terms of Use; (c) your violation of any consumer or resident rights; or (d) any operational or care disputes between your facility and a client or resident matched via the platform.
9. California Civil Code Section 1789.3 Consumer Notice
Under California Civil Code Section 1789.3, California residents are entitled to the following specific consumer rights notice: The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 N. Market Blvd., Suite S-202, Sacramento, California 95834, or by telephone at (800) 952-5210 in order to resolve any outstanding complaints regarding the service or to receive further information regarding the use of the platform.
10. Governing Law and Jurisdiction
These Terms of Use, subscription models, and any transactional or platform disputes arising between RCFE Connect and facility listers shall be governed exclusively by, and interpreted in accordance with, the laws of the State of California, without giving effect to any conflict of law principles. You explicitly agree to submit to the personal and exclusive jurisdiction and venue of the state and federal courts sitting within the State of California for all legal actions, claims, or disputes arising from or in connection with rcfeconnect.com.
Implementation Notice for Administrators
To maximize legal binding power under California's strict consumer guidelines and enforce your non-refundable payment policies, make sure that checkboxes are explicitly placed at all user account registration points and subscription checkout pages stating:
“By checking this box, I acknowledge that I am at least 18 years of age, and explicitly agree to the California Governing Law, CCPA Data Consent, and the Strict Non-Refundable Fee Policy outlined in the RCFE Connect Terms of Use.”
